Subject to your statutory rights any business relationship arising with you (“the Client”) and Eryr Glas Ltd. (“EGL”) also trading as “Andrew D. Pope” and/or “Andy Pope The Confidence Coach” shall be deemed to have been formed (“the Agreement”) when this agreed by both parties and shall be subject to these terms and conditions. Any other documents supplied by the Client shall not supersede the terms and conditions herein.

All Clients must be aged 18 or over at the time of agreement.

Definitions:

“Service” shall mean any coaching, course, study program, service or other provision, regardless of the mode of delivery to the Client, to be provided by EGL to the Client as agreed between both parties. For purposes of clarity, the Service is not intended to replace or supersede any medical advice and that any decision, action or changes made by the Client and influence their personal circumstances are entirely at the Client’s own risk.

1. CLIENTS OBLIGATIONS

1.1. The Client shall be over 18 years of age and will use all reasonable endeavours to be fully engaged in the Service and any associated process.

1.2. The Client shall pay for their Services through the payment method as instructed by EGL.

2. EGL OBLIGATIONS

2.1. EGL will provide the Service to be best of their professional ability and with consideration of the information supplied by the Client.

2.2. EGL make no warranty or guarantee, expressed or implied, that the Services provide will offer any specific outcome of the Clients personal or external circumstances nor do EGL make any warranty or guarantee, expressed or implied, that the Service will meet the Client expectations.

3. LIMITATION OF LIABILITY

3.1 Except in respect of death or personal injury due to negligence, the entire liability of EGL to the Client in respect of any claim whatsoever or breach of this Agreement, whether or not arising out of negligence, shall be limited to the price paid by the Client to which the claim relates.

3.2 In no event shall EGL be liable to the Client for any loss of business, loss of opportunity or loss of profits or for any other indirect or consequential loss or damage whatsoever. This shall apply even where such a loss was reasonably foreseeable, or EGL had been made aware of the possibility of the Client incurring such a loss.

3.3 Nothing in these Terms and Conditions shall exclude or limit EGL’s liability for death or personal injury directly resulting from EGL’s negligence or that of its employees, agents or sub-contractors.

3.4 Any decision or action that the Client may make having received the Service are entirely the Clients own and the Client will remain wholly responsible for any decisions and actions that the Client takes.

4. PRIVACY POLICY

Please also see Privacy Policy on EGL website as revised from time to time and which is strictly in compliance with all statutory and legislative requirements. You may request the information which we hold on you by emailing us at [email protected] and we will send you the information (as held by us) within the appropriate legal time limit and will try to send it within 30 days.

5. OWNERSHIP AND QUALITY OF INFORMATION

Legal and beneficial title to all intellectual property rights existing in any documentation, data, know-how, methods and concepts, used or developed by EGL in providing the Service shall belong to and remain vested in EGL.

6. MISCELLANEOUS

6.1 WAIVER

6.1.1 The failure by EGL to enforce at any time or for any period any one or more of the Terms and Conditions herein shall not be a waiver of them or of the right at any time subsequently to enforce all Terms and Conditions of this Agreement.

6.2 ENTIRE AGREEMENT

6.2.1 This Agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals, oral or written. Unless expressly provided elsewhere in this Agreement, this Agreement may be varied only by a document signed by both parties.

6.3 NO THIRD PARTIES

6.3.1. Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

6.4 GOVERNING LAW AND JURISDICTION

6.4.1 This Agreement shall be governed by and construed in accordance with English law and the parties hereby submit to the exclusive jurisdiction of courts of England and Wales.

The Client shall agree to the terms and condition detailed above in their entirety and understand and acknowledge that these terms and conditions shall apply to the Services supplied by EGL.
